Penalties for DUI

DUI means operating a motor vehicle while impaired by alcohol, marijuana, medication or other controlled substances, such as methamphetamine. A driver is legally determined to be under the influence if he/she has a blood-alcohol content (BAC) of .08 or more, has used any illegal substance, or is affected by marijuana. The seriousness of the penalties increase if a driver who is under the influence causes an accident, resulting in an injury or fatality of another person, or if he/she was driving with a child in the car upon their arrest.

First DUI Offense:

  • Maximum sentence of one year in jail
  • Fines of up to $2,500
  • License suspension for a minimum of one year
  • Mandatory community service if BAC >.16
  • Possible ignition interlock device installation

Second DUI Offense:

  • Maximum sentence of one year in jail
  • Fines of up to $2,500
  • License suspension for a minimum of five years
  • If BAC > .16 an additional mandatory minimum 2 extra days in jail
  • Mandatory minimum 240 hours community service or 5 days in jail

Third DUI Offense (Class 2 Felony):

  • Maximum jail sentence of up to seven years
  • Fines of up to $25,000
  • License suspension for a minimum 10 years
  • If BAC > .16 mandatory minimum of 90 days in jail and $2,500 in fines
  • Mandatory community service
