Credit Card Fraud Penalties

Illinois law considers most credit card fraud offenses to be Class 4 felonies, which are punishable by a prison sentence between one and three years, including a fine of up to $25,000 for each offense. The use of a counterfeit, expired, forged, unissued or revoked credit or debit card is a Class 3 felony if more than $300 worth of property was acquired within a six-month period, which is punishable by a two to five year prison sentence.

The use of a credit or debit card with intent to defraud is a Class A misdemeanor if less than $150 worth of property was acquired within a six-month period. However, if more than $300 was obtained within a six-month period, it’s a Class 3 felony.
