In order to be convicted of violating a protective order in Illinois, an individual must've knowingly gone against the order declared by the judge. The prosecution would need to demonstrate that a defendant was served properly with an order of protection, or that the defendant possessed actual knowledge of the order's terms.
In Illinois, violation of an order of protection is a Class A misdemeanor, punishable by a jail sentence of up to a year and a maximum fine of up to $2,500. However, if you have a prior conviction for domestic battery or another serious violent crime, violating a protective order can be a Class 4 felony. A Class 4 felony is punishable by a prison sentence of one to three years and a maximum fine of up to $25,000.
