Felonies Designated by Class

Felonies in Illinois are organized by class and range from Class X, the most serious class of felony, to Class 4, the least serious class of felony.

  • Class X Felonies – As the most serious of felony classes, crimes that are classified as Class X felonies are punishable by six to 30 years imprisonment. One example of a Class X felony is battery with a firearm.
  • Class 1 Felonies – These felonies are punishable by four and 15 years in prison. An individual charged with sexual assault could face a Class 1 felony charge.
  • Class 2 Felonies – the minimum sentence for a Class 2 felony is three years. You could see up to a max of 5 years if charged with this felony class. Theft over $2,000 but under $10,000 and possession of certain amounts of controlled substances are considered Class 2 felonies.
  • Class 3 Felonies – You could face between 2 and 5 years imprisonment if you are convicted of a Class 3 felony. Examples of Class 3 felonies include aggravated battery and theft between $300 and $2,000.
  • Class 4 Felonies – A Class 4 felony carries a sentence between 1 and 3 years. Crimes charged as Class 4 felonies include aggravated assault, stalking and possession of 1oz to 1lb of marijuana.
