  • If the item taken has a value of $300 or less, the offense is typically charged as a Class A Misdemeanor, punishable by:
    • Up to one year in jail
    • Up to $2,500 in fines
    • Not eligible for expungement or sealing of record
  • If the item is valued more than $300, the offense is typically charged as a Class 4 Felony, punishable by:
    • Up to one to three years in prison
    • Up to $25,000 in fines
    • Not eligible for expungement or sealing of record
  • If an offender took merchandise, regardless of the value, through an emergency exit, it is considered a Class 4 felony
    • A second offense is considered a Class 3 felony, which is a two to five year prison sentence
